By downloading, installing, creating an account, or using PluckAI ("the app"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the app.

These Terms constitute a legal agreement between you and PluckAI. We may update these Terms from time to time; if we make material changes, we will notify you through the app or by email. Continued use of the app after changes constitutes acceptance.

5. Important Disclaimers

PluckAI provides AI-generated estimates only. It is not a food safety tool and should never be the sole basis for food safety decisions.

5.1 Not a Food Safety Authority

PluckAI's freshness assessments are AI-generated estimates based on visual analysis. They are provided for informational and convenience purposes only. The app is not a substitute for professional food safety guidance.

5.2 Use Your Own Judgment

Always use your own senses and judgment when determining whether produce is safe to eat. If produce looks, smells, or feels off — discard it, regardless of what the app says.

We do not guarantee the accuracy, completeness, or reliability of any freshness assessment, recipe suggestion, or nutritional information. AI analysis has inherent limitations and may produce incorrect results. Factors such as lighting, image quality, produce variety, and storage conditions can affect accuracy.

7. User-Generated Content

By sharing content on PluckAI's community feed, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce Your Content within the PluckAI app for the purpose of operating the service. This license ends when you delete Your Content or your account.

You are solely responsible for the content you post. We do not endorse, verify, or guarantee the accuracy of user-generated content. Other users' posts, tips, and recommendations are their own opinions and should not be relied upon as professional advice.

8. Account Termination

You may delete your account at any time through the app's settings. Upon deletion, your profile, posts, comments, follows, and messages will be permanently removed from our servers.

We strive to keep PluckAI available and functional, but we do not guarantee uninterrupted service. The app requires an internet connection for AI analysis and social features. Service may be affected by network issues, third-party API availability, device compatibility changes, or maintenance.

To the maximum extent permitted by applicable law:

You agree to indemnify and hold harmless PluckAI and its developers, officers, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, violation of these Terms, or infringement of any third party's rights.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

15.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the app shall first be attempted to be resolved through good-faith informal negotiation. If informal negotiation is unsuccessful, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of California.

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

16. International Users

PluckAI is operated from the United States. If you access the app from outside the United States, you acknowledge that your data will be transferred to and processed in the United States. By using the app, you consent to this transfer and agree to comply with all applicable local laws.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PluckAI regarding your use of the app and supersede all prior agreements.
